This document sets out the rules applicable to the use of the Dibalcris-Zerovec website/online store and to the purchase of products sold by the company DIBALCRIS APPRAISAL SERVICES S.R.L. (“Dibalcris”, “we” or “the seller”). The terms apply to orders placed through the online interface, orders taken through the channels associated with the website and, to the extent relevant, subsequent communications concerning payment, delivery, return, non-conformity, recall or product safety.
By browsing the website, creating an account, placing an order or using the available functions, the user confirms that they have had the opportunity to read these terms. In the case of consumers, acceptance of the terms does not limit the mandatory rights provided by consumer protection legislation and does not replace the pre-contractual information or the documents sent on a durable medium.
If an order or an individual contract contains special conditions, these prevail only for the matters they expressly regulate and within the limits of the law. The privacy policy and the procedures for return/withdrawal, withdrawal from the market, recall and information/notification of risk products supplement this document, without contradicting it.
The website is owned and operated by DIBALCRIS APPRAISAL SERVICES S.R.L., with registered office in Sat Haieu, Sînmartin commune, Str. Trandafirilor no. 61, Bihor County, Romania, Tax ID (CUI) 41244983, Trade Register number J2019001588053, EUID ROONRC.J2019001588053, represented by Mr. Bala Florin-Cristian, administrator.
Contact details for questions, orders, complaints and operational communications: office@dibalcris.ro and +40 770 397 104. The postal address above may be used for written communications, unless Dibalcris expressly indicates another address for returns or for a particular flow.

The products are offered to end customers in Romania, including individual consumers, companies and, where applicable, public institutions through SEAP. Dibalcris sells the products as a distributor, buying the drones from the importer in Romania and reselling them to the end customer.
For individual consumers, the mandatory rules on distance contracts, consumer protection, product conformity, unfair terms and data protection apply. The provisions of this document are to be interpreted in favour of maintaining these rights, not restricting them.
For companies and public institutions, the contractual conditions, the procurement documentation, the accepted offer, the order and the applicable SEAP rules may establish a different regime. The statutory 14-day right of withdrawal is intended exclusively for consumers in distance contracts and does not in any way grant legal entities or institutions an equivalent right of return.
Drones/UAS, including Agro drones, accessories and drone components are sold on the website. Dibalcris’s offer may include drones of classes C1-C6 with a class marking and drones without a class marking, depending on the product and the manufacturer’s documentation.
The products are manufactured in China and are purchased by Dibalcris from the importer in Romania. The products are presented as having a CE marking, an EU declaration of conformity and a manual; the documentation and labels actually available may vary depending on the product and batch and must be verified before each offer is published.
Dibalcris provides an operating guide on the safe use of drones through the following link: https://dibalcris.ro/#download-ghid The customer must consult the manual, the EU declaration of conformity, the operating guide, the product’s limitations and the applicable aeronautical rules before use.
Before placing the order, the customer must be able to consult essential information about the product, including the name, model, relevant characteristics, the class or the absence of a class marking where applicable, compatibility, included accessories, price, VAT, delivery costs, availability and the payment method.
Photographs, renderings, descriptions and technical values are for information purposes to the extent that they are not presented as separate contractual specifications. The customer must verify that the product is suitable for the intended purpose and take into account the operating limitations and any legal requirements for the use of UAS.
If there is a difference between the online description and the manufacturer’s documentation, Dibalcris will clarify the situation before confirming or executing the order, and the customer may request additional information through the published contact details.
The order may be placed both with the creation of an account and without an account, if the function is available. The customer is responsible for the accuracy of the data entered, for keeping the access credentials confidential and for notifying Dibalcris when they notice unauthorised use.
To receive and execute the order, the following may be requested: first and last name or company name, the identification data of the company/institution where necessary, phone number, e-mail and delivery address. For invoicing, the data necessary to issue tax documents may be requested, within the limits of the law.
The data is processed in accordance with the Privacy Policy – Dibalcris / Zerovec. The full bank card details are handled by the payment processor, not by Dibalcris, according to the flow provided by the processor.
The customer selects the product, the quantity and the available options, enters the requested data, chooses delivery and payment, checks the order summary and submits the order using the button or function indicated as creating an obligation to pay. Before submission, the customer must have the opportunity to identify and correct input errors.
The mere placing of the order does not automatically mean its acceptance by Dibalcris. Unless the interface or the confirmation clearly indicates otherwise, the contract is deemed concluded upon Dibalcris’s confirmation of acceptance of the order, sent by e-mail or on another durable medium.
Automatic messages of receipt, registration, payment or processing may confirm the receipt of a request without, in themselves, constituting acceptance of the order. Dibalcris may request clarifications, may refuse an order for justified reasons or may inform the customer of the impossibility of performance where there is a lack of stock, a manifest error, a payment problem, incomplete data or other objective reasons.
The order confirmation will contain, to the extent applicable, the identification of the products, the price, the costs, the delivery details, the payment method, Dibalcris’s details and the information necessary for exercising legal rights.
The prices displayed are expressed in lei (RON) and include VAT, except where clearly indicated otherwise. Delivery costs or other additional costs are presented before the order is submitted, to the extent that they can be determined.
For certain products or projects, the “request a quote” function may be available. Requesting a quote does not oblige Dibalcris to accept the sale, and the price and conditions become applicable only after an offer or order is submitted and accepted in the agreed form.
Dibalcris may change prices and promotions for future orders. The price applicable to an order is the one displayed at the time of placing and confirmed by Dibalcris. In the event of a manifest error in price, description or availability, Dibalcris will inform the customer and will propose correcting or cancelling the order, without affecting the applicable mandatory rights.
In the case of online payment, authorisation and processing are carried out through Netopia Payments. Dibalcris does not request or store card details.
If the payment fails, is declined, expires or is not confirmed within a reasonable period, Dibalcris may suspend performance and may cancel the order after informing the customer. Any amounts received for a cancelled order are refunded in accordance with the law and the specific situation.
Delivery methods may include courier, delivery by own means and/or pick-up from Dibalcris’s premises. Courier transport is arranged by Dibalcris, but the cost is borne directly by the customer to the courier. By exception, for orders exceeding 2,500 lei, transport is free of charge for the customer, if this condition applies to the order.
The specific delivery times are displayed on the product page or in the order flow. In the absence of a special deadline, Dibalcris will make efforts to deliver within a reasonable period and will inform the customer without undue delay if delays occur.
The customer must check, as far as possible, the apparent integrity of the parcel upon receipt and record any visible damage in the courier’s documents. Such a check does not limit the legal rights regarding non-conformity, hidden defects, withdrawal or the carrier’s liability.
The risk of loss of the products passes to the end customer on the date of handover.
The consumer has the right to withdraw from a distance contract within 14 days, without giving a reason, in compliance with the conditions of GEO no. 34/2014. The period runs, as a rule, from the date on which the consumer or a third party indicated by them, other than the carrier, takes physical possession of the goods; for multiple deliveries or goods in batches/pieces, the special statutory rules apply.
Withdrawal may be communicated by e-mail, the contact form available on the website, the online withdrawal function if available, or any unequivocal statement sent before the period expires.
After communicating the withdrawal, the consumer sends the goods back without undue delay and, in any case, no later than 14 days after the communication, unless Dibalcris has offered to collect the goods. The consumer must pack and handle the product so that transport takes place safely and must keep proof of dispatch.
Dibalcris refunds the payments received, including the standard delivery costs, without undue delay and no later than the legal deadline. Dibalcris may postpone the refund until it receives the goods or until it receives proof of dispatch, as the case may be.
The consumer is liable only for the diminished value resulting from handling that goes beyond what is necessary to establish the nature, characteristics and functioning of the product. The original packaging and all accessories are not absolute conditions that eliminate the legal right; Dibalcris will document and be able to prove any diminution claimed.
The exceptions to the right of withdrawal apply only in the cases provided by law and only if they genuinely apply, for example for sealed products that cannot be returned for health protection or hygiene reasons and have been unsealed, or for other situations expressly provided by GEO no. 34/2014. Dibalcris does not extend the list of statutory exceptions through this document.
Withdrawal without reason is distinct from non-conformity. If the product does not conform to the contract, the description, the legal requirements or the promised characteristics, the consumer may benefit from the remedies provided by GEO no. 140/2021 and the applicable legislation, depending on the situation.
Remedies are assessed in accordance with the law and may include, as applicable, bringing the product into conformity through repair or replacement, a price reduction or termination of the contract.
The terms and conditions of the commercial warranty are those communicated to the customer by the manufacturer, through the product’s warranty certificate.
The complaint is submitted through the contact form available on the website or by e-mail, with the order/invoice number, the product, the serial number, the description of the problem, the date it was noticed and, if necessary, relevant photographs or documents. The customer does not need to send flight data, images or other personal data that are not necessary for resolution.
Dibalcris does not carry out service or repairs for the products sold. The post-return check of software erasure/reinstallation and basic functional test, where applicable to a return without defect or risk, is solely an internal check and is not service, warranty diagnosis or a remedy for non-conformity.
Any technical intervention on the product that goes beyond the internal post-return checks, including diagnosis, technical configuration, repair or software update or reinstallation where specialised technical intervention is required, is carried out exclusively by the manufacturer or by a partner authorised by the manufacturer, in accordance with its procedures and instructions.
Withdrawal from the market refers to products in stock, in transit, at distributors or at other points in the supply chain, before they reach the end user. It aims to prevent the product from being made available and is not presented as an obligation of return for the end user.
If the product has reached the end user, the case is escalated for analysis of recall and information, in accordance with the relevant internal procedures.
Recall refers to products already sold or supplied to end users where there is non-conformity, risk, serious risk, an instruction from the manufacturer/importer or a request from AACR or another competent authority.
The customer or end user must not pass the product on to another user and must not ship a product suspected of risk without safety instructions communicated by Dibalcris or by the competent entity. The costs and the measure offered are communicated in the specific notification, depending on the case and the law.
Where there is a reported defect, incident, accident, breakdown, lack of markings/documents, non-conformity, risk or reasonable doubt, Dibalcris may initiate the information and notification procedure. Depending on the situation, this coordinates the flow of withdrawal from the market, recall, public warning or another measure.
Precautionary measures may include temporary suspension of use, blocking of offers, orders and deliveries, separation of the available products and informing economic operators, authorities and end users.
The communication must include, to the extent applicable, the case number and contact, the identification of the product and of the serial number/batch, the manufacturer/importer and the available origin, the quantity and channels affected, the nature of the non-conformity and the risk, the measure adopted or proposed, clear instructions and the deadline for a reply.
The minimum instructions to the customer/user are: stop using the product, do not pass the product on to anyone else, do not ship it without safety instructions and comply with the instructions communicated for return or recall.
The customer and the end user are responsible for using the product in accordance with the manual, the operating guide, the technical limitations, the safety warnings, the aeronautical rules and the instructions of the competent authorities. Before flight, the user must check the operating conditions, the airspace, the category of the operation and any obligations of registration, training, authorisation or insurance.
The user must operate the drone so as not to endanger persons, property, other aircraft, the environment or aviation safety and must respect the rights concerning private life, image and data protection. Dibalcris is not liable for use contrary to the law, the manual, the warnings or the manufacturer’s instructions, within the limits permitted by law.
Any incident, accident, defect or suspected risk must be reported without delay to Dibalcris and, where necessary, to the competent authorities. Flight data, images or other personal data are not requested unnecessarily.
Depending on the actual configuration of the platform, the customer may receive automatic notifications by e-mail and other channels for: customer registration, account activation, password recovery, order completion, order modification, order cancellation, failed payment, sending of the payment link, delivery, back-in-stock, contact form, product information, return form and warranty form.
Communications concerning return, recall, suspension of use or product safety may also be sent, where necessary to perform the contract, comply with the law or protect persons. The exact list and names of the messages are configured according to the active functions of the platform.
Operational messages do not constitute marketing when they are necessary for the order, payment, delivery, account, return, warranty, recall or safety. Dibalcris may send such messages even if the person does not want promotional communications, to the extent necessary for the operational purpose.
Newsletters, SMS messages, push notifications, offers and personalised ads are sent only in accordance with the law and, where necessary, on the basis of consent. Consent must be freely given, specific, informed and unambiguous and may be withdrawn at any time.
The customer may unsubscribe through the link available in the message, through the account settings or by contacting Dibalcris. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal and does not stop the necessary operational communications.
The right to object to direct marketing may be exercised at any time. Preferences for each channel must be manageable separately when the technical mechanism allows it.
Cookies and similar technologies are used for technical operation, session, security, remembering preferences, analytics, affiliation and marketing. Details about cookies and the tools actually active can be found in the “Privacy Policy”.
Non-essential cookies must be activated only after consent has been obtained where the law requires it. The user must be able to accept, refuse or change their preferences without the refusal preventing access to the strictly necessary functions.
The processing of personal data is carried out in accordance with the Privacy Policy – Dibalcris / Zerovec and Regulation (EU) 2016/679. Identification and contact data, billing and payment data, technical and usage data, cookie data, data from complaints and communications, marketing data and data necessary for product traceability may be processed.
Dibalcris may use or disclose data to Gomag, Netopia Payments, couriers and delivery providers, IT and security providers, Mailchimp, manufacturers/importers/partners and AACR or other authorities, only to the extent necessary for the purpose and on a legal basis.
The retention periods are those indicated in the Privacy Policy and must be correlated with tax, accounting, contractual and compliance obligations. Account data, data of customers without an account, orders, invoices and identity document data have distinct periods and conditions.
Data subjects may exercise their GDPR rights, including access, rectification, erasure, restriction, portability, objection, withdrawal of consent and the right to lodge a complaint with the competent supervisory authority. Requests may be sent to office@dibalcris.ro, +40 770 397 104 or to the controller’s postal address.
The names, trademarks, logos, texts, photographs, graphics, website structure, descriptions and other materials belong to Dibalcris, its partners or their holders and are protected by the applicable legislation. Purchasing a product does not transfer copyright, trademark, design or other rights over the website content.
Use of the website for personal and lawful purposes, for information and purchase, is permitted. Systematic copying, reproduction, distribution, modification, commercial exploitation, automated data extraction and use of the content without the holder’s consent are prohibited, except within the limits permitted by law.
The user must provide real data and use the website without violating the law, the rights of other persons or the security of the platform. Unauthorised access, testing or compromising of systems, transmission of malicious software, use of another person’s identity, fraudulent orders and the use of bots or other automated means without authorisation are prohibited.
Dibalcris may limit, suspend or close an account and may refuse or cancel an order where there are reasonable suspicions of fraud, breach of the terms, security risk, abusive use or a legal obligation. The measure will be proportionate and, where possible, the customer will be informed.
Suspension of the account does not affect the consumer’s rights already acquired or the legal obligations to keep documents or to resolve a complaint.
Dibalcris makes reasonable efforts to keep the website operating, but does not guarantee uninterrupted availability, absence of errors or compatibility with every device and browser. The website may be temporarily suspended for maintenance, updates, security, third-party providers or causes beyond Dibalcris’s control.
Dibalcris is not liable for delays or non-performance caused by force majeure, fortuitous events, network interruptions, cyber-attacks, supplier failures, restrictions imposed by authorities, strikes, disasters or other external events, within the limits of the law. Dibalcris will make efforts to limit the effects and inform the affected customers.
Dibalcris may amend these terms when the website, products, suppliers, order flows, legal requirements or compliance measures change. The current version will be published on the website at the confirmed official address and will indicate the date of the update.
Amendments do not affect contracts already concluded, except in situations permitted by law or necessary for their performance. For important changes, Dibalcris may inform users through the website, e-mail or other appropriate channels.
Complaints may be submitted through the contact form available on the website, at office@dibalcris.ro or at +40 770 397 104. For efficient resolution, the customer must state their name/company name, contact details, order number, the product and a clear description of the problem or request.
Dibalcris will review the complaint and reply within a reasonable period, taking into account the nature of the request and the applicable mandatory deadlines. For non-conformity, the customer must allow the necessary checks and must not carry out unauthorised technical interventions that may affect the assessment of the product.
Consumers retain the right to contact the National Authority for Consumer Protection (ANPC) and to use the current legal mechanisms for alternative dispute resolution, under the conditions and through the official procedures valid at the date of the complaint.
The relationship between Dibalcris and the customer is governed by Romanian law, without prejudice to the mandatory rules applicable to consumers, including those concerning distance contracts, product conformity, unfair terms, data protection and legal liability.
For professional customers, disputes are resolved by the courts competent under the law and the valid agreement between the parties. For consumers, any clause on the jurisdiction of the courts applies only within the limits permitted by the mandatory rules and does not deprive the consumer of the protection conferred by law.
